General Terms and Conditions

These terms and conditions apply to all retreats, group trips and activities organized by Sunrise Senegal.

Article 1 – Definitions

  1. Sunrise Senegal is a trade name of Maureen van de Lustgraaf, registered with the Chamber of Commerce under number 09164812.

  2. Agreement: the agreement that is concluded through registration by the participant and confirmation by Sunrise Senegal.

  3. Participant: the natural person who registers for participation in a retreat, group trip or other activity of Sunrise Senegal.

Article 2 – Registration and Confirmation

  1. Registration takes place via e-mail or via an online registration form.

  2. After receipt of the completed form, the participant will receive a confirmation by e-mail, accompanied by an invoice.

  3. The registration is binding, personal and takes place in order of receipt.

  4. In case of group registration, a separate form must be completed for each participant.

Article 3 – Formation of Agreement

  1. The agreement is concluded as soon as Sunrise Senegal confirms the registration in writing.

  2. The person registering on behalf of others is jointly and severally liable for the obligations of all registered persons.

  3. Registration of minors is only valid with written consent from a legal representative.

Article 4 – Payment

  1. The participant will receive an invoice after registration.

  2. For retreats, a fixed deposit of €1,000 per person applies upon registration.

  3. For group trips, a fixed deposit of €600 per person applies upon registration.

  4. The remaining amount must be paid in full no later than 8 weeks before the start.

  5. In case of registration within 8 weeks before the start, the full amount is immediately due.

  6. In the event of non-payment or late payment, Sunrise Senegal reserves the right to unilaterally cancel participation, without refund of amounts already paid.

  7. All judicial and extrajudicial collection costs arising from non-payment are for the account of the participant.

Article 5 – Changes and Cancellation by Sunrise Senegal

  1. Sunrise Senegal reserves the right to cancel a retreat or group trip in case of insufficient registrations (fewer than 5 participants), no later than 21 days before the start. In that case, the participation fee already paid will be fully refunded.

  2. In case of force majeure (such as natural disasters, illness, political unrest, travel restrictions or other unforeseen circumstances), the programme may be modified, postponed or cancelled.

  3. If cancellation takes place due to force majeure, the participation fee already paid will be refunded, after deduction of demonstrably incurred costs that can no longer be recovered.

  4. Sunrise Senegal is not liable for additional costs such as flight, visa or insurance costs.

Article 6 – Liability

  1. Participation in a retreat, group trip or activity organised by Sunrise Senegal is entirely at the participant’s own risk.

  2. Sunrise Senegal acts as the organiser of the retreats, group trips and activities and serves as the primary point of contact for the participant.

  3. Parts of the programme may be carried out by local partners, guides or service providers in Senegal or other countries. These individuals operate on behalf of Sunrise Senegal.

  4. Sunrise Senegal shall not be liable for any damage (direct or indirect), loss, theft or damage to personal property, personal injury or other harm, unless such damage is solely the result of intent or gross negligence on the part of Sunrise Senegal.

  5. Sunrise Senegal shall not be liable for damage resulting from:
    a. force majeure;
    b. acts or omissions of third parties not directly under its supervision;
    c. acts or negligence of the participant.

  6. In all cases, any liability of Sunrise Senegal shall be limited to a maximum of the amount of the participation fee paid by the participant.

  7. If damage results from proven intentional misconduct or gross negligence of a local executing partner, Sunrise Senegal will make reasonable efforts to hold the relevant party accountable, without prejudice to the above limitation of liability.

  8. The participant is responsible for assessing their own physical and mental fitness for participation.

Article 7 – Participant Responsibilities

  1. The participant must behave respectfully and responsibly during the retreat, group trip or activity.

  2. In case of misconduct or disruption, exclusion without refund may follow. Any additional costs are for the account of the participant.

Article 8 – Cancellation by Participant and Substitution

  1. Cancellation of participation must be made in writing, by e-mail with confirmation of receipt or by registered letter.

  2. In case of cancellation up to 8 weeks before the start, the deposit remains due.

  3. In case of cancellation within 8 weeks before the start, the full participation fee is due.

  4. The participant may be replaced by another person, provided that Sunrise Senegal grants prior written permission and the replacement is communicated no later than 14 days before the start.

Article 9 – Prices

  1. The prices applicable at the time of registration apply.

  2. Prices include accommodation, guidance, meals and program components, unless otherwise stated.

  3. Sunrise Senegal reserves the right to adjust prices in case of force majeure or significantly changed market conditions, insofar as this relates to future bookings.

  4. Different prices may apply for future editions or years.

Article 10 – Right of Withdrawal

  1. If the participant is a consumer who books at a distance (via e-mail or internet), the statutory right of withdrawal of 14 days applies in principle.

  2. However, the right of withdrawal does not apply to agreements relating to accommodation, transport, catering services or leisure activities, if the agreement provides for a specific date or period of performance.

  3. If, in a specific case, the right of withdrawal does apply and the participant makes use of it within the statutory period, the participant will receive a full refund.

Article 11 – Privacy

  1. Sunrise Senegal processes personal data in accordance with applicable privacy legislation.

Article 12 – Travel and Cancellation Insurance

  1. The participant is obliged, before the start of the retreat or group trip, to take out valid travel insurance, including medical coverage, for the entire travel period.

  2. For activities with a travel or accommodation component, the obligation to take out appropriate insurance also applies.

  3. For other activities, Sunrise Senegal may set additional conditions with regard to insurance or liability.

  4. The participant is furthermore advised to take out cancellation insurance that covers the participation costs in case of unforeseen circumstances.

  5. Sunrise Senegal may, prior to the start of the retreat or group trip, request proof of these insurances (insurer, policy number and emergency number).

  6. If the participant cannot demonstrate valid travel insurance, Sunrise Senegal reserves the right to refuse participation, without refund of amounts already paid.

  7. Sunrise Senegal is not liable for costs or damage resulting from the absence of (valid) insurance.

By submitting the registration form, the participant declares to have taken note of these general terms and conditions and to agree with them. These general terms and conditions apply to the agreement between the participant and Sunrise Senegal.
